Despite her refusal to engage in sexual activities, Counter forcibly took her to a secluded area near a water tank. The court heard that “she attempted to fight him off, but he overpowered her and forcefully slept with her. She attempted to scream, but he wrapped his hands around her neck and strangled her while continuing to sexually assault her.”

The severity of Counter’s actions became apparent when he realized the girl was no longer resisting. As stated in court, “He realized that she was no longer resisting and pulled her body up to a sitting position, but it slid to the side, and she did not respond when he called her name.”
