LALIGA achieves a historic milestone by obtaining the first conviction in Spain for racist insults in football. The three culprits have been sentenced to eight months in prison, in addition to the impossibility of accessing a stadium for two years.

He June 10, 2024 It was a day that will go down in history, as it will represent the anniversary of a battle won in the fight against hatred and violence in Spanish professional football. A triumph that exemplifies the efforts of LALIGA for more than a decade to achieve such objectives, intensified this season through its platform LALIGA VSwhich has established itself as a fundamental pillar in the promotion of a inclusive and respectful sports environment.
The reason for the complaint was the racist chants he suffered Vinícius Jr.Real Madrid player, in the league match that pitted the white team against the Valencia CF, on May 21, 2023, in Camp de Mestalla. The sentence has declared the three defendants guilty of a crime against moral integrity, as recorded in art. 173.1 of the Penal Code, with an aggravating circumstance of discrimination for racist reasons (art. 22.4 Penal Code).
The ruling has been supported by a multitude of countries and influential personalities from around the world, demonstrating that Society is aware of the problem of racism, condemning and rejecting negative hateful behaviors.. In this context, the constant effort of LALIGA has been fundamental in achieving this achievement.
LALIGA VS & MOOD
LALIGA VS is an initiative of the sports organization and its clubs that aims to eliminate hate inside and outside the stadiums, promoting a society based on respect and inclusion in all its areas. The platform aims inspire and raise awareness to the fans, using the values of football for them.
In the last ten years, LALIGA, together with its clubs, have launched more than 700 initiatives linked to the eradication of violent, racist, homophobic, misogynistic and offensive behaviour in the stadiums, based on the education, prevention and actiondemonstrating LALIGA’s firm commitment to combating racism, both inside and outside football stadiums.
One of the latest developments, which is part of LALIGA VSes MOOD, Monitor for the Observation of Hate in Sportswhich consists of a conversation monitoring tool on social networks of Spanish professional football. MOOD allows us to take another step in the detection and eradication of violence in football and society, by monitoring the level of hatred that occurs on social networks around LALIGA.
According to the analysis of MOOD regarding the sentence, they have been taken into account counts 115,500 conversations among a total of 92,700 userswith a range of 2.031.159.241. The results indicate that the predominant reaction to the Vinícius Jr. case is support, with a 87% of the conversation in favor. This demonstrates a high level of positive conversation. This victory in the courts is a clear example of the path of zero tolerance with all kinds of violence that is being built with LALIGA VS.
An unprecedented court ruling
The sentence requested from the accused amounted to 12 months in prison, but has been reduced by a third, as a result of the agreement in the investigation phase, remaining at 8 months in prison along with the costs of the procedure. Furthermore, the guilty parties will not be able to access football stadiums where LALIGA and/or RFEF matches take place, for a period of two years.
Valencia has demonstrated its firm commitment to the fight against racismactively collaborating to identify those responsible and expel them as members of the club, making it clear that there is no place for racism in their community.
It’s about the first conviction of this type that is effective in Spain. To the LALIGA’s initial complaint before the Courts of Justice, the RFEF, Real Madrid and finally, the victim, the player Vinícius Jr. joined in. During the judicial act, the three defendants read a letter in which they apologized to the player, LALIGA and Real itself Madrid.
After the conviction, the president of LALIGA, Javier Tebashighlighted: “This sentence represents a crucial advance in the fight against racism in Spain by repairing the damage suffered by Vinícius Jr. In addition, it sends a strong message to those who attend football stadiums with the intention of insulting: LALIGA will detect them, report them and there will be legal consequences“. Tebas acknowledged that “frustration over judicial deadlines is understandable, but this reflects the judicial guarantee in Spain. From LALIGA, we respect these times and advocate for a legislative evolution that allows LALIGA to have sanctioning powers to expedite the response against racism.”
Zero tolerance for racism
LALIGA has led the fight against racism, denouncing, since the 2015/2016 season, any type of violence that occurred inside and outside the stadiums, before the State Commission against Violence, Racism, Xenophobia and Intolerance in Sports, as well as before the RFEF Competition Committee.
The organization decided to go one step further, and in January 2020, as a result of racist insults to Athletic Club player Iñaki WilliamsLALIGA went directly to justice for those cases of hate crimes classified in the Penal Code, either through the Hate Prosecutor’s Office, the Courts or the Security Bodies and Forces.
In its commitment to the fight against racism, LALIGA has requested on several occasions that the Law 19/2007 against violence, racism, xenophobia and intolerance in sport, as well as Law 39/2022, to be able to have sanctioning powers in this type of cases, being able to reduce sanction times.
